Retired Judge Lyudmila Solomakha has successfully secured an increase in her pension: the court's decision mandated the Pension Fund of Ukraine to disburse her monetary entitlement.

This is stated in the court ruling documents. The new pension amount will be retroactively applied starting from January 1, 2024.

According to case materials No. 200/6643/24, Lyudmila Solomakha, who previously served in the Donetsk Appeals Court, approached the Pension Fund requesting the calculation of her pension, which should amount to 68% of the judges' remuneration.

She noted that the remuneration for judges in her position had increased from 196,537 to 283,118 hryvnias, which, in her opinion, warranted an adjustment of her pension payments.

The Pension Fund denied her request, citing the lack of funds in the state budget and the unchanged salary of judges. In her lawsuit, Solomakha emphasized that retired judges are entitled to a pension recalculation based on changes in the remuneration components of active judges, and she claimed that the Pension Fund's refusal constituted a violation of her rights.

The court ruled in favor of the plaintiff, ordering the Main Department of the Pension Fund in the Lviv region to recalculate based on a certificate from the Donetsk Appeals Court dated August 2024. As a result, the retired judge's pension will increase to 192,520 hryvnias per month.
