A man in the Lviv region challenged the inaction of the Territorial Center for Staffing (TCC), and the court ruled in his favor.
The case materials are published in the Register of Judicial Decisions.
The Lviv court granted the claim of a father of multiple children with a second group disability, who complained that the TCC did not respond to his request for a deferment from mobilization submitted by mail. The court deemed the TCC's inaction unlawful and mandated the center to submit the necessary documents.
It is known that the claim was filed by a father of three minor children with a second group disability. From May 2023 to February 2024, the man contacted the TCC three times with requests for deferment, yet received no response. He asked the court to recognize the TCC's inaction as illegal and to obligate the center to consider his application.
A representative of the TCC did not exercise the right to submit a response to the claim. The court established that the man included a copy of his pension certificate, a certificate from the Medical and Social Expert Commission, birth certificates of the children, and other documents in his application. His last submission with documents was sent at the end of February 2024, and according to postal tracking, the TCC received it in early March. However, the man still did not receive a response.
The court ruled that the TCC's inaction is unlawful and violates the applicant's right to have his deferment application considered. The claim of the Lviv region resident was granted, and the TCC was ordered to review his application.
