In Ukraine, a general mobilization continues, during which men aged 25 to 60, who are subject to military service, are being called up.
Lawyer Tamila Aleksik explained to TSN and "Radio Liberty" who can be declared wanted by the Territorial Recruitment Center (TRC) and what consequences this has for citizens.
Who may be declared wanted by the TRC
As noted by the lawyer, to declare a person wanted, it is necessary to initiate a criminal case for evading mobilization. This occurs when a man receives a summons but fails to appear at the TRC. The process is as follows:
The TRC and the Security Service provide the police with information regarding a person's evasion of mobilization if they did not appear for the summons or did not update their military records.
The police initiate a criminal case and enter the information into the unified register of pre-trial investigations.
Aleksik emphasized that before a person is declared wanted, they must be served with a notice of suspicion, which is sent by mail to their place of residence. Only after this does the search procedure begin.
What awaits a citizen if declared wanted by the TRC
As explained by Maksym Akhrameiev, head of the Preventive Activities Department of the National Police of Ukraine, after the information is entered into the system, the police search for individuals. A control mechanism is provided by a resolution of the Cabinet of Ministers.
Police officers verify the receipt of information, and if the individual's location is established, they may detain and deliver them to the TRC for clarification of circumstances and to draw up an administrative protocol.
When can the case be closed?
As Maksym Akhrameiev points out, if a man against whom a case has been opened can confirm valid reasons for his non-appearance at the TRC, the administrative case will be closed. Otherwise, he faces a fine.
